{"id":1256,"date":"2024-03-13T15:50:08","date_gmt":"2024-03-13T15:50:08","guid":{"rendered":"http:\/\/mona"},"modified":"2024-11-04T13:34:54","modified_gmt":"2024-11-04T13:34:54","slug":"blog-post-title-18","status":"publish","type":"post","link":"https:\/\/frauenlandwirtschaft.ch\/fr\/blog-post-title-18\/","title":{"rendered":"Le r\u00f4le des lois"},"content":{"rendered":"<div data-elementor-type=\"wp-post\" data-elementor-id=\"1256\" class=\"elementor elementor-1256\" data-elementor-post-type=\"post\">\n\t\t\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-6a120f1a elementor-section-full_width elementor-section-height-default elementor-section-height-default\" data-id=\"6a120f1a\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-no\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-4e37094c\" data-id=\"4e37094c\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-3d04afb2 elementor-widget elementor-widget-text-editor\" data-id=\"3d04afb2\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>La motion 19.3445 \u00ab Indemniser \u00e9quitablement le conjoint ou le partenaire enregistr\u00e9 d\u2019un exploitant agricole en cas de divorce \u00bb a \u00e9t\u00e9 d\u00e9pos\u00e9e au Parlement f\u00e9d\u00e9ral en 2019 et transmise aux deux Conseils. \u00c0 l\u2019automne 2023, la Conf\u00e9d\u00e9ration a pr\u00e9sent\u00e9 une proposition de mise en \u0153uvre et l\u2019a mise en consultation.<\/p><h2>La prise de position<\/h2><p>D\u2019apr\u00e8s les r\u00e9sultats du projet alors obtenus et l\u2019expertise de longue date de la BFH-HAFL sur le th\u00e8me des femmes dans l\u2019agriculture, l\u2019\u00e9quipe de projet a \u00e9labor\u00e9 une prise de position sur le projet de loi propos\u00e9 et l\u2019a transmise \u00e0 l\u2019Office f\u00e9d\u00e9ral de l\u2019agriculture, responsable de la proc\u00e9dure de consultation.<\/p><h2>Un pas dans la bonne direction<\/h2><p>L\u2019\u00e9quipe de projet salue le fait que le Parlement et la Conf\u00e9d\u00e9ration souhaitent am\u00e9liorer la situation des nombreuses \u00e9pouses et quelques \u00e9poux qui collaborent \u00e0 l\u2019exploitation familiale. L\u2019adaptation de la loi pr\u00e9voit que, pour obtenir des aides financi\u00e8res destin\u00e9es \u00e0 des am\u00e9liorations structurelles \u00e0 l\u2019\u00e9chelle de l\u2019exploitation, le couple doit se faire conseiller ensemble sur le r\u00e9gime matrimonial et sur la r\u00e9glementation relative \u00e0 la collaboration au travail de son ou sa conjoint-e, et\/ou apporter la preuve du paiement d\u2019une r\u00e9mun\u00e9ration en esp\u00e8ces ou d\u2019une partie du revenu. C\u2019est un grand pas dans la bonne direction.<\/p><h2>Seulement 70% sont concern\u00e9s<\/h2><p>Cependant, cette exigence est li\u00e9e \u00e0 l\u2019Ordonnance sur les am\u00e9liorations structurelles et ne concerne donc qu\u2019environ 70% des exploitations, et avant tout celles en montagne. D\u2019apr\u00e8s diff\u00e9rentes \u00e9tudes et ses propres enqu\u00eates, <strong><a href=\"https:\/\/frauenlandwirtschaft.ch\/wp-content\/uploads\/2024\/07\/Maeder_2023_SozialeAbsicherungLandwirtschaft_Quantitativ.pdf\" target=\"_blank\" rel=\"noopener\">(Travail de bachelor de M\u00e4der Jonas<\/a> <\/strong>l\u2019\u00e9quipe de projet estime toutefois que la situation des femmes dans l\u2019agriculture est pire que le rapport de la Conf\u00e9d\u00e9ration ne la pr\u00e9sente. L\u2019adaptation de la l\u00e9gislation propos\u00e9e n\u2019est donc qu\u2019une premi\u00e8re \u00e9tape vers l\u2019alignement du r\u00e9gime matrimonial et du droit social agricoles sur ceux qui s\u2019appliquent au reste de la population.<\/p><h2>Le r\u00f4le du conseil<\/h2><p>La proposition contenue dans le projet de loi, qui consiste \u00e0 commencer par le conseil, doit \u00eatre examin\u00e9e d\u2019un \u0153il critique. Diff\u00e9rents projets de sociologie agricole de la BFH-HAFL montrent que les conseill\u00e8res et conseillers agricoles ont des difficult\u00e9s \u00e0 aborder des th\u00e8mes \u00ab sociaux \u00bb dans le cadre de leur activit\u00e9. Ces r\u00e9ticences sont dues au fait que les conseill\u00e8res et conseillers ne se sentent pas assez comp\u00e9tents, mais aussi parce que ces personnes ne veulent pas s\u2019immiscer dans la vie priv\u00e9e de la famille paysanne. Une r\u00e9cente \u00e9tude de la BFH-HAFL<strong><a href=\"https:\/\/frauenlandwirtschaft.ch\/wp-content\/uploads\/2024\/07\/Helfenstein_2023_SozialeAbsicherungLandwirtschaft_Qualitativ.pdf\" target=\"_blank\" rel=\"noopener\"> (Bachelorthesis von Helfenstein Simon)<\/a> <\/strong>sur la protection sociale des conjoint-e-s qui collaborent \u00e0 l\u2019exploitation a en outre montr\u00e9 que les repr\u00e9sentations traditionnelles des r\u00f4les de genre des conseill\u00e8res et conseillers peuvent \u00e9galement interf\u00e9rer.<\/p><h2>Les \u00e9tapes suivantes n\u00e9cessaires<\/h2><p>Au vu de ces \u00e9l\u00e9ments, l\u2019\u00e9quipe du projet a donc propos\u00e9 des mesures suppl\u00e9mentaires pour am\u00e9liorer la situation des conjoint-e-s dans l\u2019agriculture, notamment des adaptations de la loi sur le droit foncier rural et des dispositions sur la pr\u00e9voyance professionnelle.
